Artikel 1 - Definities
In deze algemene voorwaarden wordt verstaan onder:
- Verhuislift Huren Nederland: de verhuurder van verhuisliften, gevestigd te Lijnbaansgracht 231, 1017PH Amsterdam, KvK 99121999
- Huurder: de natuurlijke of rechtspersoon die een verhuislift huurt
- Verhuislift: het gehuurde materieel inclusief toebehoren
- Huurperiode: de overeengekomen periode waarvoor de verhuislift wordt gehuurd
- Huurprijs: de totale prijs inclusief BTW en reiskosten
Artikel 2 - Toepasselijkheid
2.1 Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, offertes en overeenkomsten tussen Verhuislift Huren Nederland en de huurder.
2.2 Afwijkingen van deze voorwaarden zijn alleen geldig indien deze schriftelijk zijn overeengekomen.
2.3 De toepasselijkheid van eventuele inkoop- of andere voorwaarden van de huurder wordt uitdrukkelijk van de hand gewezen.
Artikel 3 - Totstandkoming van de overeenkomst
3.1 De overeenkomst komt tot stand op het moment dat de huurder de reservering bevestigt via onze website of telefonisch.
3.2 Verhuislift Huren Nederland behoudt zich het recht voor om reserveringen te weigeren zonder opgaaf van redenen.
3.3 De huurder ontvangt een bevestiging per e-mail met de details van de reservering.
Artikel 4 - Prijzen en betaling
4.1 Alle prijzen zijn inclusief BTW en reiskosten, tenzij anders vermeld.
4.2 De huurprijs wordt berekend op basis van het aantal uren, de afstand tot de locatie en eventuele weekendtoeslag.
4.3 Betaling dient te geschieden conform de op de factuur vermelde betalingstermijn.
4.4 Bij niet-tijdige betaling is de huurder van rechtswege in verzuim en is Verhuislift Huren Nederland gerechtigd wettelijke rente en incassokosten in rekening te brengen.
4.5 Verhuislift Huren Nederland behoudt zich het recht voor om vooruitbetaling of een aanbetaling te verlangen.
Artikel 5 - Annulering en wijziging
5.1 Annulering door de huurder dient schriftelijk (per e-mail) te geschieden.
5.2 Bij annulering gelden de volgende voorwaarden:
- Meer dan 48 uur voor aanvang: geen kosten
- Tussen 24-48 uur voor aanvang: 50% van de huurprijs
- Minder dan 24 uur voor aanvang: 100% van de huurprijs
5.3 Wijzigingen in de reservering zijn kosteloos mogelijk tot 48 uur voor aanvang, onder voorbehoud van beschikbaarheid.
5.4 Verhuislift Huren Nederland behoudt zich het recht voor om een reservering te annuleren bij overmacht, waarbij de huurder de reeds betaalde bedragen volledig terugkrijgt.
Artikel 6 - Levering en retournering
6.1 De verhuislift wordt op de afgesproken datum en tijd geleverd op de opgegeven locatie.
6.2 De huurder dient ervoor te zorgen dat de locatie bereikbaar en geschikt is voor plaatsing van de verhuislift.
6.3 De huurperiode begint op het moment van levering en eindigt op het afgesproken tijdstip.
6.4 Bij overschrijding van de huurperiode worden extra kosten in rekening gebracht.
6.5 De verhuislift wordt door Verhuislift Huren Nederland opgehaald op het afgesproken tijdstip.
Artikel 7 - Gebruik en zorgplicht
7.1 De huurder is verplicht de verhuislift op een zorgvuldige en veilige wijze te gebruiken.
7.2 De huurder mag de verhuislift alleen gebruiken voor het beoogde doel (verhuizen van goederen).
7.3 Het is de huurder niet toegestaan om:
- De verhuislift door te verhuren aan derden
- De verhuislift te verplaatsen naar een andere locatie zonder toestemming
- De maximale belasting van de verhuislift te overschrijden
- Gevaarlijke of illegale goederen te vervoeren
7.4 De huurder dient zich te houden aan alle veiligheidsvoorschriften en instructies.
Artikel 8 - Aansprakelijkheid en verzekering
8.1 De huurder is aansprakelijk voor alle schade aan de verhuislift tijdens de huurperiode, tenzij deze schade het gevolg is van een gebrek aan de verhuislift.
8.2 De huurder is aansprakelijk voor schade aan derden die ontstaat door het gebruik van de verhuislift.
8.3 Verhuislift Huren Nederland is niet aansprakelijk voor schade aan goederen die met de verhuislift worden vervoerd.
8.4 Verhuislift Huren Nederland is niet aansprakelijk voor indirecte schade, gevolgschade of bedrijfsschade.
8.5 De aansprakelijkheid van Verhuislift Huren Nederland is in alle gevallen beperkt tot het bedrag dat in het betreffende geval door de verzekeraar wordt uitbetaald.
8.6 De huurder wordt geadviseerd om een eigen verzekering af te sluiten voor schade aan goederen en aansprakelijkheid.
Artikel 9 - Overmacht
9.1 Verhuislift Huren Nederland is niet gehouden tot het nakomen van enige verplichting indien zij daartoe verhinderd wordt als gevolg van overmacht.
9.2 Onder overmacht wordt verstaan: extreme weersomstandigheden, stakingen, brand, overheidsmaatregelen, pandemieën en andere omstandigheden buiten de wil van Verhuislift Huren Nederland.
9.3 Bij overmacht heeft de huurder recht op terugbetaling van reeds betaalde bedragen of het verplaatsen van de reservering naar een andere datum.
Artikel 10 - Klachten
10.1 Klachten over de geleverde diensten dienen binnen 24 uur na levering schriftelijk te worden gemeld.
10.2 Verhuislift Huren Nederland zal klachten zo spoedig mogelijk behandelen en binnen 14 dagen reageren.
10.3 Het indienen van een klacht schort de betalingsverplichting van de huurder niet op.
Artikel 11 - Geschillen
11.1 Op alle overeenkomsten tussen Verhuislift Huren Nederland en de huurder is Nederlands recht van toepassing.
11.2 Geschillen zullen bij voorkeur in onderling overleg worden opgelost.
11.3 Indien geen oplossing wordt bereikt, zijn de geschillen onderworpen aan de bevoegde rechter in het arrondissement Amsterdam.
Artikel 12 - Privacy
12.1 Verhuislift Huren Nederland verwerkt persoonsgegevens conform de Algemene Verordening Gegevensbescherming (AVG).

Artikel 13 - Wijziging voorwaarden
13.1 Verhuislift Huren Nederland behoudt zich het recht voor deze algemene voorwaarden te wijzigen.
13.2 Wijzigingen worden van kracht 30 dagen na publicatie op de website.
13.3 Op reeds gesloten overeenkomsten blijven de voorwaarden van toepassing die golden op het moment van totstandkoming.

Article 1 - Definitions
In these terms and conditions, the following terms are defined as:
- Verhuislift Huren Nederland: the rental company for moving lifts, located at Lijnbaansgracht 231, 1017PH Amsterdam, Chamber of Commerce 99121999
- Renter: the natural or legal person renting a moving lift
- Moving lift: the rented equipment including accessories
- Rental period: the agreed period for which the moving lift is rented
- Rental price: the total price including VAT and travel costs
Article 2 - Applicability
2.1 These terms and conditions apply to all offers, quotations, and agreements between Verhuislift Huren Nederland and the renter.
2.2 Deviations from these terms are only valid if agreed upon in writing.
2.3 The applicability of any purchase or other conditions of the renter is explicitly rejected.
Article 3 - Formation of the agreement
3.1 The agreement is formed when the renter confirms the reservation via our website or by phone.
3.2 Verhuislift Huren Nederland reserves the right to refuse reservations without stating reasons.
3.3 The renter receives a confirmation by email with the reservation details.
Article 4 - Prices and payment
4.1 All prices are inclusive of VAT and travel costs, unless stated otherwise.
4.2 The rental price is calculated based on the number of hours, distance to the location, and any weekend surcharge.
4.3 Payment must be made in accordance with the payment term stated on the invoice.
4.4 In case of late payment, the renter is automatically in default and Verhuislift Huren Nederland is entitled to charge statutory interest and collection costs.
4.5 Verhuislift Huren Nederland reserves the right to require advance payment or a deposit.
Article 5 - Cancellation and modification
5.1 Cancellation by the renter must be done in writing (by email).
5.2 The following conditions apply to cancellations:
- More than 48 hours before start: no costs
- Between 24-48 hours before start: 50% of the rental price
- Less than 24 hours before start: 100% of the rental price
5.3 Changes to the reservation are free of charge until 48 hours before start, subject to availability.
5.4 Verhuislift Huren Nederland reserves the right to cancel a reservation in case of force majeure, whereby the renter receives a full refund of amounts already paid.
Article 6 - Delivery and return
6.1 The moving lift is delivered on the agreed date and time at the specified location.
6.2 The renter must ensure that the location is accessible and suitable for placement of the moving lift.
6.3 The rental period starts at the time of delivery and ends at the agreed time.
6.4 Additional costs will be charged if the rental period is exceeded.
6.5 The moving lift is collected by Verhuislift Huren Nederland at the agreed time.
Article 7 - Use and duty of care
7.1 The renter is obliged to use the moving lift in a careful and safe manner.
7.2 The renter may only use the moving lift for its intended purpose (moving goods).
7.3 The renter is not permitted to:
- Sublet the moving lift to third parties
- Move the moving lift to another location without permission
- Exceed the maximum load of the moving lift
- Transport dangerous or illegal goods
7.4 The renter must comply with all safety regulations and instructions.
Article 8 - Liability and insurance
8.1 The renter is liable for all damage to the moving lift during the rental period, unless this damage is the result of a defect in the moving lift.
8.2 The renter is liable for damage to third parties arising from the use of the moving lift.
8.3 Verhuislift Huren Nederland is not liable for damage to goods transported with the moving lift.
8.4 Verhuislift Huren Nederland is not liable for indirect damage, consequential damage, or business damage.
8.5 The liability of Verhuislift Huren Nederland is in all cases limited to the amount paid out by the insurer in the relevant case.
8.6 The renter is advised to take out their own insurance for damage to goods and liability.
Article 9 - Force majeure
9.1 Verhuislift Huren Nederland is not obliged to fulfill any obligation if prevented from doing so as a result of force majeure.
9.2 Force majeure includes: extreme weather conditions, strikes, fire, government measures, pandemics, and other circumstances beyond the control of Verhuislift Huren Nederland.
9.3 In case of force majeure, the renter is entitled to a refund of amounts already paid or to reschedule the reservation to another date.
Article 10 - Complaints
10.1 Complaints about the services provided must be reported in writing within 24 hours after delivery.
10.2 Verhuislift Huren Nederland will handle complaints as soon as possible and respond within 14 days.
10.3 Filing a complaint does not suspend the renter's payment obligation.
Article 11 - Disputes
11.1 Dutch law applies to all agreements between Verhuislift Huren Nederland and the renter.
11.2 Disputes will preferably be resolved through mutual consultation.
11.3 If no solution is reached, disputes are subject to the competent court in the Amsterdam district.
Article 12 - Privacy
12.1 Verhuislift Huren Nederland processes personal data in accordance with the General Data Protection Regulation (GDPR).

Article 13 - Amendment of terms
13.1 Verhuislift Huren Nederland reserves the right to amend these terms and conditions.
13.2 Changes take effect 30 days after publication on the website.
13.3 Agreements already concluded remain subject to the terms that applied at the time of formation.
